Use of your personal information

Welcome to Ecologi’s Privacy Policy. When you use our services, you’re trusting us with your information. This Privacy Policy will inform you as to how we look after your personal data when you use our services. We like to think that we are as ethical about your privacy as we are about climate action.


Who we are

Ecologi is a trading name of Ecologi Action Ltd (“we”, “us”, or “our”, “Ecologi”) and we are committed to protecting and respecting your privacy as well as the planet.

We want you to know and understand why we need certain personal data and what we will do with it. Underlying all our purposes is our passion to plant trees & fund the world’s best climate crisis solutions to help make a difference to the impact that we directly or inadvertently have on our environment. You may need to give us your personal data to use our Services (subscriptions, purchases or events that you care about all the way through to planting trees and everything else that we do to help you become carbon neutral).

This Privacy Policy applies to the website ecologi.com and any others managed by us such as event websites (e.g. itstime.earth) (“the Websites”). The Websites are owned and operated by Ecologi Action Ltd, a privately owned company incorporated in England & Wales (company number 11911630) whose registered office is at 483 Green Lanes, London, N13 4BS. By using the Websites, you are accepting and consenting to the practices described in this Privacy Policy.

For the purpose of the “Data Protection Laws” (the Data Protection Act 2018, which implemented the EU’s ‘GDPR’, and any amendments or additions enacted and any other laws relating to Personal Information), the data controller in respect of the Websites is Ecologi Action Ltd, a company incorporated in England & Wales (company number 11911630) whose registered office is at 483 Green Lanes, London, N13 4BS.

Any changes we may make to this policy and how we use your data in the future will be posted on this page and, where appropriate, notified to you by email. Please check back frequently to see any updates or changes to this policy.


Information that we may collect from you

Personal Information is information that identifies you specifically (such as your name, address, phone number, email address, your internet protocol address (“IP address”)). The types of Personal Information we collect and share depend on the service you have with us. We only collect such information when you choose to supply it to us. You confirm that the information you enter about yourself is true.

Information that you provide on your profile page at ecologi.com and share publicly is your choice and under your control. In the account settings for your profile we provide the option to make your profile private in which case this Privacy Policy shall apply to any information on your profile page that has not been shared.

Information you give us

Some parts of the Services require you to actively submit information for you to benefit from specific features, or by corresponding with us by phone, e-mail or otherwise. This includes information you provide when you register to use our site, subscribe to our Services, participate in discussion boards or other social media functions on our site, enter a competition, promotion or survey, and when you report a problem with our site. The information you give us may include Personal Information.

Information we collect about you

Automated anonymous information may be collected when you interact with us via the Websites and with our emails, which may include but is not limited to:

  • Technical information such as your computer’s or mobile device’s operating system and browser type, the address of a referring website, if any, and the path you take through our web pages;

  • Cookies are used to recognise you as you use or return to our site. Cookies are bits of text that can be placed on your computer’s or mobile device’s hard drive when you visit certain websites. Cookies may enhance your online experience by saving your preferences while you are visiting a particular site.   • Remarketing information which lets us reach out to you when you search on Google using our keywords or visit other websites. You may be shown an ad that might encourage you to return to our site; third-party vendors, including Google and Facebook, show our ads on sites across the Internet.

  • These providers help us carry out many of the above activities. We only give them the parts of your Personal Information that they need. And we make it clear to them that they must keep your personal data safe and only use it for those specific services.

  • Clickstream information such as the address (or URL) of the website that you came from before visiting our site, which pages you visit on the site, which browser you used to view the site and any search terms you may have entered on the site, among other things.

  • Web beacons allow us to know if a certain page was visited or an email was opened, when you open the email, your IP address, your browser or email client type, and other similar details.

  • When you use our site on your mobile device, we may collect information about the type of device and operating system you use. We may ask you if you want to receive push notifications about activity in your account.

  • If you opt-in to these notifications and later no longer want to receive them, you may turn them off through your operating system.

Information we receive from other sources

We may receive information about you if you use any other websites we operate or the other services we provide. In this case we will have informed you when we collected that data that it may be shared internally and combined with data collected on this site. We are also working closely with third parties (including, for example, business partners, sub-contractors in technical, payment and delivery services, advertising networks, analytics providers, search information providers, credit reference agencies) and may receive information about you from them.

Microsoft

  • When you visit our Websites, Microsoft sets cookies based on your visits and searches you make on Bing in order to show you relevant adverts on Bing and MSN. These Cookies are called ‘MUID’ and ‘MR’ and are stored for between 6 months and two years.

Facebook

  • Facebook uses cookies and receives information when you visit our Websites, including device info and information about your activity. This occurs whether or not you have a Facebook account or are logged in. These are stored under the Facebook domain.

  • You can opt out if you have a Facebook account or adjust your browser settings if you don’t have an account.

Google

  • When you visit our Websites, Google sets cookies to remember your preferences, that’s things like your language and your latest searches. Google also uses cookies to help customise ads on Google and for advertising served across the web.

  • Cookies are also set for Google Adwords – that’s the platform that powers the text adverts you see in your Google search results. There is lots of very helpful info directly provided by Google about how they use cookies.

  • You can use Ads Settings to manage the Google ads you see and opt out of Ads Personalisation. Even if you opt out of Ads Personalisation, you may still see ads based on factors such as your general location derived from your IP address, your browser type, and your search terms.

Custom and Lookalike Audiences

  • We use Custom and Lookalike Audiences at Ecologi to advertise to existing and potential customers via social media platforms.

  • A Custom Audience is a type of audience created made up of existing customers. We target ads to the audience we have created across common social media channels, outlined below.

  • We also work with carefully selected partners to create Lookalike Audiences: which are lists of people to target with advertising who are similar to (or ‘look like’) people currently engaging with us.

  • For both types of activity (custom audiences and lookalike audiences) we aim to target people based on aggregate customer behaviour.

Disclosure of your information

  • collecting your comments if you choose to provide feedback through our Website (Legal basis for processing: Processing is conducted based on consent);

  • for undertaking any other permitted use of your Personal Information on our behalf (Legal basis for processing: Processing for the purpose of our legitimate interest); and

  • sending email invitations to our customers to review the Ecologi platform and our service.

These service providers will only have access to the Personal Information needed to perform the relevant service and may not use your Personal Information for any other purpose. They will also be required to use your Personal Information strictly in accordance with their applicable data protection laws, including maintaining adequate security measures to protect such Personal Information.

We may also share your personal information with legal or regulatory authorities where we are lawfully requested or required to do so.

We may disclose your Personal Information to third parties:

  • In the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets;

  • If Ecologi or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets;

  • If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, this includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

Where we store your personal data

We take the security of your data very seriously. We employ physical, electronic and administrative security measures to protect the information that we collect about you from access by unauthorised persons and against unlawful processing, accidental loss, destruction and damage. You acknowledge and agree that we shall not be responsible for any unauthorised use, distribution, damage or destruction of personal data, except to the extent we are required to accept such responsibility by the Data Protection Laws.

You should be aware that your data may be transferred, processed and stored outside of your country (including, if you are located in the European Union, outside of the European Union), and that your data may be subject to disclosure as required by applicable law. It may also be processed by staff operating outside the UK or EEA who work for us or for one of our suppliers. Such staff may be engaged in, among other things, the fulfilment of your order, the processing of your payment details and the provision of support services. By submitting your Personal Information, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with our Privacy Policy.

Whenever we transfer your personal data out of the UK and/or the EEA, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

  • We will only transfer your personal data to countries that have been deemed to provide an adequate level of protection for personal data.

  • Where we use certain service providers, we may use specific contracts approved for use in the UK which give personal data the same protection it has in the UK.

All information you provide to us is stored on secure servers hosted within Amazon Web Services within the European Union or on our encrypted computers. Where we have given you (or where you have chosen) a password which enables you to access certain parts of our site, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

Any payment transactions will be encrypted and processed by our payment service provider. Your use of the payment service provider is governed by their terms which will be linked to prior to making any payment. We do not store the full PAN or any of the following: cardholder name, expiration date and/or service code (“Cardholder Data”) ourselves but this will be securely processed by our payment service provider.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our site; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to prevent unauthorised access.

You have the right to:

Request access to your personal data (commonly known as a “data subject access request”). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.

Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.

Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.

Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.

Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios:

  • If you want us to establish the data’s accuracy.

  • Where our use of the data is unlawful but you do not want us to erase it.

  • Where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims.

  • You have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.

Request the transfer of your personal data to you or to a third party. We will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.

Withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent. The CCPA

If you are a resident of California, you have some specific rights concerning your data. You can exercise these rights by contacting us at hq@ecologi.com.

You have the right to know about the personal information we have collected from you, how it is used and how it is shared.

You have the right to delete the personal information we have on you (there are some exceptions to this).

You have the right to opt-out of the sale of your information (We won’t ever sell your information, don’t worry! But we will tell you you still have the right to ask about it).

You have the right to non-discrimination when using these rights under the CCPA.

NO FEE USUALLY REQUIRED

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances.

WHAT WE MAY NEED FROM YOU

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

TIME LIMIT TO RESPOND

We try to respond to all legitimate requests within one month. Occasionally it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

Deactivating your account

Upon request from you by going to your profile page on the website, selecting Account, then selecting Manage Subscription and (at the bottom of the page) clicking on the ‘Close my account’ button, we will deactivate your account and render your Personal Information unusable as soon as reasonably possible, in accordance with applicable law. We do retain personal information from closed accounts to comply with law, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations, enforce our terms and conditions, and take other actions otherwise permitted by law.
